The Beautiful House Company, (BHC) arranges short term rentals of properties as agents of the owners of the properties. The contract is between the owners of the property and the guest. The contract will be entered into once the guest’s deposit has been processed. BHC will confirm the booking by sending the guest a booking confirmation. The contract will be subject to all the following booking conditions:
For all bookings BHC require a deposit payment of 30% of the total rent. The balance becomes payable 3 months before the start of the rental. Where a booking is made within 3 months of the start of the rental, the full rental amount must be paid. Failure to pay the balance on or before the due date shall be construed as a cancellation of the booking by the guest. Payment can be made by electronic transfer, cheque, debit card, Visa or Mastercard (there is a 2.5% surcharge for payments made by credit card).
Any cancellation made by the guest for whatever reason must be made in writing and sent to BHC. On receipt of the notice of cancellation, BHC will endeavour to re-let the Property. If BHC succeeds in re-letting the Property for the whole of the period booked it shall refund an amount equal to the money paid less an administration fee of £25. If BHC is unable to re-let the property then all monies paid by the guest shall be forfeited to BHC. BHC strongly recommends guests to take out cancellation insurance should they be in any doubt as to their ability to fulfil an existing booking commitment.
CHANGE OF DATES
BHC may consider a request from a guest to change the dates of the booking after confirmation has been issued. Agreement will be given subject to the request being received in writing more than 8 weeks away from the commencement of the booking and the property owner agreeing to the change.
PERIOD OF HIRE
Rentals commence at 4.00pm on the day of arrival and terminate at 10.00am on the day of departure.
USE OF THE PROPERTY
The number of guests occupying a property must not exceed the maximum number as stated for each property, with no additional guests allowed to visit. Some properties may allow additional guests for an extra charge – this must be arranged before the stay commences. The property will be used for personal, domestic purposes only and cannot be sub-let to third parties. The property shall not be used for any commercial purposes without the prior consent of BHC. The property owner or BHC reserves the right to refuse entry to the entire party, or take a deduction from the cautionary deposit, if these conditions are not observed.
Should there be any cause for complaint during the occupation of the property, please contact the property owner or housekeeper promptly during your stay. Owners will only investigate complaints which are notified to them during the guests stay as any dispute relating to the rental itself will be a matter directly between the guest and the owner.
CARE OF THE PROPERTY
By making a booking, the guest agrees to take full responsibility for all members of his/her group and to ensure that reasonable and proper care is taken of the property both internally and externally including the property’s contents. The guest agrees to keep the property clean and tidy throughout the rental and will leave it at the end of the rental in the same condition, state, and repair in which they found it on their arrival. Failure to meet this standard will result in a charge being levied against the cautionary deposit. Any defects or breakages that become apparent to the guest at the start of the rental must be notified to the owner/house manager. Unless any such matters are reported, the guest accepts that the property was received in a clean and tidy condition and in good repair.
BREAKAGES OR DAMAGE
A cautionary deposit is held to cover any losses, damage and additional cleaning charges, if the property is left in an unsatisfactory condition. The guest hereby agrees to give authorization to deduct from the cautionary deposit the cost of replacement, repair or extra cleaning associated with any damage or breakage that takes place during the period of their stay.
Dogs are permitted at some properties as detailed on our website. They must be under proper control at all times. No pets other than dogs are permitted.
NO SMOKING POLICY
All BHC properties operate a total no-smoking policy.
BHC (for itself, its employees and agents) shall not be under any liability to the guests or third parties for any accident, damage, loss, injury, expense or inconvenience, which may be suffered, incurred, arise out of or in any way be connected to the rental. No term of this agreement is enforceable under the Contracts (Rights of Third Parties) Act 1999 by a person who is not a party to it. If the Property which the guest has booked becomes unavailable or unusable for an unforeseen reason prior to the date of booking, then BHC’s obligations will be limited to using its best endeavours to find a suitable alternative property for the client, or, should this not be possible for whatever reason, reimbursing the guest for any monies paid in respect of the booking.
BHC does not warrant and takes no responsibility for the accuracy of any verbal information given or statements made by its employees or agents.
RIGHT OF ENTRY
The property owners shall be allowed the right of entry to the property at all reasonable times for the purposes of inspection or to carry out any necessary repairs or maintenance.
BHC and the owner, acting on their own behalf or by their employees or agents reserve the right to terminate the contract and require, without refund, the immediate departure of all persons from the property in the event of a serious breach of the terms of the contract and these booking conditions. The breach may include but is not limited to any of the following events:
1) serious damage to the property which may exceed the cautionary deposit;
2) a criminal or illegal act;
3) unreasonable or abusive behaviour;
4) excessive noise which could adversely affect the rights of BHC or the owner to be able to continue to use the property for short term rentals or involve authorities or police in any form of complaint investigation.
It is strongly recommended that the guest takes out a comprehensive travel insurance policy, which will include cancellation cover and full cover for the party’s personal belongings as no such cover is provided by BHC or the owner. Accordingly, any such losses incurred are the responsibility of the guest. It is further recommended that the guest take out personal liability and accidental damage insurance for all members of the party to cover against any damage to the property, and protect against loss in the event of a deduction from the cautionary deposit.
